Dealer Terms and Conditions

Customers wishing to become a dealer of McDurmon Distributing should carefully read the following Terms and Conditions. Submission of the New Dealer Application implies that you have read and accepted these Terms and Conditions.

  • Vendor Restrictions:

    • Quicksilver parts and related accessory sales are restricted to dealers within the United States of America. 
  • Prices:

    • Due to the instability of raw materials, prices are subject to change without notice. Customers are encouraged to check prices online for the most up-to-date prices.
  • Terms:

    1. Terms are net 10, prox. to qualified accounts.
    2. Past due accounts may be changed to COD without notice until brought current.
    3. McDurmon Distributing accepts many methods of payment including company check, cash, major credit cards and electronic fund transfer.
    4. Customers wishing to apply for open account status must complete a credit application.
  • Ordering:

    1. To provide prompt delivery and low prices, all orders less than $25 will incur a $5 handling fee.
    2. Add-ons will not be allowed to orders previously placed.
    3. Customers have the option to place their orders in “Next Order Status” for later shipment. It is the customer’s responsibility to request shipment or to close the order.
    4. Online customers receive a 1% discount on all online orders.
  • Backorders:

    1. Despite McDurmon Distributing’s efforts to maintain a high percentage of line fill, back order situations may occur. In these situations, back orders over $25 will ship automatically.
    2. Back orders under $25 will be placed on next order status and will ship with a customer’s next order.
    3. Back orders on next order status will automatically be cancelled after 30 days.
    4. Customers are responsible for cancelling any back order they do not want shipped.
  • Special Orders:

    1. Special orders cannot be cancelled or returned.
    2. Delivery time of special orders is at the discretion of our vendors.
    3. Some special orders may require pre-payment and/or a completed and signed Special Order Agreement Form.
  • Drop Shipments:

    1. A $5 charge is applied to all drop ship orders. Drop ship fees are waived for online orders.
    2. McDurmon Distributing will not drop ship from our vendors to retail customers.
    3. Drop shipments apply to open accounts in good standing and credit card customers only.
  • Freight Allowance:

    1. Normal freight may be deducted per the following terms ONLY if the invoice is paid by the due date. COD accounts will receive prepaid freight on orders meeting the same requirements.
    2. COD charges, hazardous material charges, drop ship fees, and air freight may not be deducted.
    3. Freight deductions are not allowed on past due accounts. Open accounts that are past due will default to COD terms until the account is brought up to date.
    4. McDurmon Distributing reserves the right to choose the freight carrier on any freight prepaid or freight deduct shipment.
    5. Purchases of engines, drives, powerheads, and machinery will require payment in advance and will ship F.O.B. origin of shipment.
    6. Lubricants, antifreeze, engines, shrinkwrap, and machinery are excluded from freight allowances.
    7. The minimum order to achieve freight allowance is $300.
    8. All freight policies are subject to change without notice.
  • Returns:

    1. Merchandise cannot be marked, soiled, or disfigured in any way and must be in its original carton or package.
    2. Any merchandise returned to McDurmon Distributing for any reason, must have prior authorization and be accompanied by a Returned Goods Authorization (RGA) number before being returned. RGA numbers will be valid for 30 days from issue date. Please include invoice number and date of purchase with all returned merchandise.
    3. Merchandise may be returned within 15 days from date of invoice for full credit as long as the merchandise was purchased from McDurmon Distributing and is in new and saleable condition. Merchandise returned after 15 days will be charged a 15% restocking fee.
    4. No merchandise will be accepted after 30 days from the date of invoice.
    5. All unauthorized returns will be returned freight collect.
    6. Duplicate shipments or shipments of wrong merchandise not ordered can be returned for full credit, provided they are reported within 10 days of shipment date and have an RGA number.
  • Warranties:

    • If a purchased product is found to be defective, it may be returned to McDurmon Distributing with a Returned Goods Authorization (RGA) number for repair, replacement, or credit according to the terms of the manufacturers’ warranty policies.
  • Lost or Damaged Shipments:

    1. Merchandise that is lost or damaged in shipment is the responsibility of the carrier.
    2. All lost or damaged claims must be filed with the carrier.
